Membership Terms and Conditions

Upon acceptance of the accompanying Membership Application by THE WEYBRIDGE COLLECTION GLOBAL EXCHANGE PROGRAM (“Weybridge”), which is subject to approval by Weybridge in its sole discretion, and a credit and/or background check, the signer(s) of the accompanying Membership Application (hereafter referred to as “Member”) shall be considered a Member of WEYBRIDGE COLLECTION GLOBAL EXCHANGE PROGRAM (“Exchange Program”) for a period of 10 year(s). This agreement shall continue to be in effect for as long as the Member chooses to pay the annual dues which is currently $1,500 (this fee subject to reasonable change).

Membership in the Exchange Program is subject to the following Terms and Conditions:

Application and Cancellation

  1. Member shall submit to Weybridge a complete signed Membership Application, along with an Initiation Fee in the amount of $10,000 via Visa, MasterCard, Check, or Money Order. Checks shall be mailed to the offices of Weybridge at 2502 North Clark St. Suite 230 Chicago, IL 60614. Credit card payments may be accepted through the Weybridge Collection global exchange program website, e-mailed or faxed to 773-549-2886. Member shall also submit the documentation set forth on Exhibit A.
  2. Weybridge has the right and is authorized to order a credit and/or background check on the undersigned.
  3. The member has 10 days to cancel following the execution of the contract. Notice of cancellation, if given by mail, shall be deemed given when deposited in mailbox, properly addressed and postage prepaid.
  4. Within 10 days after notice of cancellation is received, Weybridge shall refund the Initiation Fee made by Member. However, Weybridge may retain payments for reasonable out-of-pocket expense incurred. The refund may be made by crediting the Member’s credit card account if a credit card was used to make a payment and if Weybridge informs the Member in writing that the credit card account has been credited.
  5. The right of cancellation afforded the Member herein is nonwaivable.

Acceptance and Initial Weybridge Currency; Family Members

  1. Upon acceptance of the Member’s Application and receipt of the Initiation Fee, an Initial Weybridge Currency (“Currency”) value shall be assigned to each new property added to the collection by the new Member. The Currency will be based on the approximate market rental value of their required two Guaranteed Weeks. Once the Currency is assigned and reflected in the system, the Member is eligible to use the Currency immediately. Currency may be changed in the reasonable judgment of Weybridge.
  2. Weybridge Members are allowed to assign their Currency to immediate family for their use. Such family members shall be considered by Weybridge to be an “Associate Member” of Weybridge. When an Associate Member uses a Weybridge property, the Weybridge Member will agree to assume full responsibility for the actions of the Associate Member. Before arranging an agreement between an Associate Member and a Hosting Member, Weybridge will inform the Hosting Member that the person/party who wishes to be/will be visiting his/her/their property is an Associate Member and the Hosting Member shall be allowed to decide whether or not he/she/they are willing to host an Associate Member.

Reservations

  1. All requests must be made using the on-line reservation and calendar system.
  2. Weybridge will make every reasonable effort to fulfill each request for accommodations made by a Member.
  3. Host and Guest shall receive Confirmations from Weybridge (”Confirmation”) once both parties agree to the terms of the Reservation.
  4. Only after Weybridge sends out the Confirmations shall an agreement be considered Final. Guests should never make their travel arrangements (airfare, car rental, etc.) until they have received their Confirmation.
  5. As a Member of the Exchange Program you agree that Weybridge shall not be held liable for any consequential or incidental costs which the Guest has incurred in the process of arranging their intended stay in the Host’s property (airfare, car rental, etc.).

Guaranteed Weeks

  1. All members of the Exchange agree to make available at least one “High Season” week and one “Shoulder Season” week for their Property available to other Weybridge members each year. These are known as Guaranteed Weeks. If one High Season passes in which a Member refuses to host a Weybridge Member, that Member may, in the discretion of Weybridge, lose his/her membership in the Exchange Program.
  2. As one week is used by a Member of the Exchange Program, the Host Member is required to immediately add an additional week to the calendar. This week must be scheduled within the following 12 month period.
  3. A “High Season” week must be replaced by a “High Season” week and a “Shoulder Season” week can be replaced by a “Shoulder Season” or “High Season” week.

Currency

  1. Currency for Hosting another Weybridge member in your property shall be awarded at such time as both the “Host Confirmation” and “Guest Confirmation” are sent out by Weybridge. Once confirmation is made 33% of the Currency value is non-refundable, at 90 days prior to the stay, another 33% of the Currency is non-refundable, and finally at 30 days prior to the stay, the remaining 33% of the Currency is non-refundable.
  2. In the event that a Guest cancels a particular request for accommodations after signing his/her “Guest Intent”, the Host shall retain his/her points as outlined in paragraph 1 above, regardless of whether or not Weybridge is able to “re-book” the property for the stated time period.
  3. When a Guest requests an reservation and the Host denies the request, the Host forfeits 20% of the Currency for that particular week. This Currency is then rewarded to the Guest.
  4. Currency values for properties may fluctuate according to season. If a Property is not a rental property, Currency values may be assigned according to the market rental rates of comparable properties in the same geographic location. Weybridge will look at the seasonality, daily and weekly rental rates to help determine the appropriate Currency value.
  5. If a Member does not use the initial Currency allotment within 18th months after receiving it, the Member can lose 50% of their Currency.
  6. Additional Currency may be awarded to any Member at the discretion of Weybridge.
  7. Currency may be taken away at any time by Weybridge for violation of any Exchange Program guidelines or rules.

Additional Fees

The only additional fees required by the Hosting Member will be the payment for all housekeeping/cleaning fees for the property before, during and after the stay. Therefore, when the Hosting Member becomes a Guest, no additional fees will be required except for specific concierge services requested.

Optional Time

After they have contributed their two required Guaranteed Weeks, the Host Member may open up as little or as much optional time as they wish. This optional time can be for any length of time. The Currency value can be any amount determined by the Host Member and this optional time can be changed at any time as long as no reservation has yet to be made.

Restrictions

  1. When hosting a Weybridge Guest, Hosts agree to have accessories and furnishings, linens and towels, carpets and kitchen equipment and all other interior and exterior property features in the condition stated on (or superior to that stated in) their Membership Application, and they agree to immediately inform Weybridge of any changes in the property’s condition (for better or for worse).
  2. Hosts agree that their Weybridge Guests have the right to use all amenities customarily connected with their property.
  3. During the time period a Property is used by a Weybridge Guest, the Weybridge Member shall not have use of the Property.
  4. Guests are always responsible for any/all damages which any member of their party causes to their Host’s property during their stay in that property. In the event that a Weybridge Member refuses to be responsible for, and make full financial restitution for, any/all damage to their Host’s property, caused by themselves or anyone in their party, that Weybridge Member shall lose their Membership in Weybridge.
  5. Each Member must provide appropriate government issued photo identification which must be presented at check-in at the Property.
  6. Guests are responsible for any/all personal expenses incurred during their stay in a Host’s property. Furthermore, Guests agree to use personal cellular phones, credit calling cards, phone cards and/or make collect telephone calls for non-local calls during their stay in a Host’s property.
  7. Weybridge Members who have received Confirmation that they are to be Guests in another Weybridge Member’s property for an agreed upon period of time, agree to waive all claims against Weybridge in the event that a reserved property becomes unavailable due to natural disaster, an Act of God, and/or any event beyond the control of Weybridge.
  8. Weybridge Members are always free to place reasonable restrictions upon the use of their properties, such as restrictions regarding the ages of children allowed in their properties, smoking restrictions, etc.
  9. Guests shall never have Pets in or around their Host’s property unless prior permission has been granted by their Host.
  10. Guaranteed weeks have a weekly minimum stay running Saturday to Saturday. Check-in/check-out times will vary by location and property but as a rule check-in is at 4 p.m. on the arrival date and check-out is no later than 10 a.m. on the approved departure date.
  11. Each property will have a specified maximum number of occupants. Guests will not have more than this maximum number of Guests during their occupancy period. Stiff penalties will apply for any violation including being asked to vacate the property and loss of Currency and loss of Membership.

Miscellaneous Provisions

A Host Member will be asked to provide the Guest 10 unique Experiences to choose from during their stay that will enhance the overall experience for the Guest

Insurance

All Weybridge Members are required to have and maintain homeowner’s insurance appropriate to cover any/all non-paying guest(s) in their Weybridge Member Properties.

Designated Representative

Corporate Properties are to name an Authorized Representative to act as their liason with Weybridge and this Representative shall be authorized by the Corporation to make decisions in the Corporation’s behalf. The Corporation shall honor the Representative’s promises/decisions/signature.

Sale of Property

Member agrees to notify Weybridge if and when a Weybridge Exchange Program Property is being marketed for sale. Weybridge will allow Member to transfer his/her Exchange Program Membership to another property and will allow the buyer of the original property to become a Member of Weybridge (subject to reference checks). Should Member sell his/her Member Property, all accrued but unused Currency in the Weybridge system shall be usable by that Member as long as that Member remains in good standing with Weybridge.

Governing Law

This Agreement shall be governed exclusively by the laws of the State of Illinois, and any legal action taken by a Member against Weybridge must take place within the courts of Cook County, Illinois, USA. Acceptance and Maintenance of the Weybridge Collection global exchange program is acceptance of, and consent to, the personal jurisdiction of these courts. The undersigned, by signing this Weybridge Membership Application, agrees to pay all court costs incurred by Weybridge in the event that an action of law or in equity is initiated by Member against Weybridge in which Weybridge prevails.

Termination by Weybridge

Weybridge has the right to suspend or terminate this membership without further obligation should Member fail to comply with the Terms and Conditions of the Weybridge Membership Application, with all Currency accrued forfeited.

Miscellaneous

The Terms and Conditions of this Agreement are subject to change. Weybridge will make every reasonable effort to inform all members of any/all significant changes.

Acceptance

Member hereby agrees to the foregoing membership terms and conditions.

Member Member

You may cancel this membership without any penalty or obligation, within ten calendar days from your execution of this contract unless you have already used the Exchange Program provided in this agreement. If you have already used the Exchange Program, you may still cancel this transaction within ten calendar days from your execution hereof, but you are not entitled to a refund of any prior payments.

To cancel this transaction, mail or deliver a signed and dated copy of this cancellation notice or any other written notice or send telegram to:
